The building had originally been built as a garage but at a later date the owners applied to alter the building and use it as an annex ancillary to the main house. The annex application had raised some objections and as such the final decision was made at the planning committee just over 10 years ago. At that committee it was decided that the use would be restricted not only be a planning condition but also a Section 106 planning legal agreement.
RCC were approached to see if we felt a case could be made to lift these restrictions and allow the annex to be used as an independent dwelling and ultimately be sold off separately form the main house. We felt there was a strong case to be made but we recommended the first step was a planning application to in essence remove the restrictive planning condition and if that was approved we could then apply to remove the Section 106 agreement.
We were delighted when the council agreed that planning permission should be granted for the independent use of the annex. The next step is to deal with the Section 106 agreement.
