This was a site that RCC had previously worked on with a commercial equestrian use but we were contacted when our client had a visit from the council's planning enforcement officer because they had been using an old ancillary building a a self-contained rental, which needed planning permission.  We were therefore asked to apply for retrospective consent on their behalf.

RCC were confident that the proposal could be acceptable having regard to principle planning policy issues, even through the council thought otherwise, but there were complicated issues around flooding and nutrient neutrality.  The application was subsequently refused on three grounds; planning policy principle, flood risk and nutrient neutrality.  We pursued a planning appeal for our client and whilst the appeal was dismissed RCC won the overall planning argument on the principle of the use.

Sometimes a planning appeal is dismissed but all is not lost, it might be that the issues can still be overcome with another planning application and that is what we did here.  Safe in the knowledge that the principle planning issue was now agreed we could engage further specialists to deal with the flooding and nutrient neutrality issues.  RCC have a number a excellent consultants we use for a variety of specialisms and together we put together the second application.  

We are now delighted to say that our client has full planning permission with the council agreeing that all objections had been overcome.
