Section 73 applications allow us to amend the design and layout of an approved dwelling without having to submit a whole new full application.  This can very useful if policy or guidance has changed since the time of the original planning permission, as was the case here.

The complication on this site was that the original application was for two dwellings and the  Section 73 application had to cover both plots but the plots were now in separate ownership.  In total we applied to vary four planning conditions that related to the approved drawings but also a number of issues, including drainage design.  We carefully set out our case as to how the council could vary the conditions so as to approve details on out our clients plot whilst the council still have control over the development on the other plot.

There was one query around one condition but we quickly presented a solution that satisfied the council and the permission was granted.
