RCC had previously obtained a Class Q permission for this site, which was an excellent result, but it was better for our clients to have a full planning permission instead.  Class Q is a permitted development right to convert agricultural buildings to residential use but these consents need to be fully implemented within 3 years, whereas a full planning application only needs to be started within 3 years.

However, in this countryside location away from any settlement, local and national planning policies would normally only allow conversion of existing buildings and wouldn't allow a new build dwelling.  RCC therefore presented the proposal using case law supporting the new build dwelling due to the ‘fall back’ position of the Class Q permission.

When you use case law like this to go against normal planning policies you have to present the case fully to the council, and in this instance the planning officer had to attain advice from a manager due to the nature of the proposal.  RCC were very confident with the case present and were very pleased when the full planning permission was issued under delegated powers.
