There had been a long battle to attain permission for the conversion of a building outside of the defined settlement boundary as a holiday let due to highway safety issues.  However once permission had been granted our client's circumstances were such that they needed to use the building as a permanent dwelling for family members.  This meant there was a breach of the holiday let occupancy condition.  

Following an enforcement investigation RCC were asked to prepare an application to remove the planning condition but the council refused the application and subsequently served an enforcement notice requiring the permanent occupation of the building to cease. RCC were then instructed to proceed with an appeal against the refusal of planning and the enforcement notice where we set out our case on a number of fronts, including the council's lack of a 5 year housing land supply.  

We were so pleased when a positive decision came back and our client's family are now free to continue to live in the property on a permanent basis.
